  1. Introduction: PRO-Cashew is a USDA program implemented by CNFA in Benin, Burkina Faso, Côte d'Ivoire, Ghana, and Nigeria. The objective of the PRO-Cashew project is to improve efficiency, production quality, trade and more coherent regional trade and investment policies in Benin, Burkina Faso, Côte d’Ivoire, Ghana, and Nigeria.



The PRO-Cashew project will increase and improve the productivity and profitability of smallholder-owned cashew orchards in targeted countries, through R&R capacity building and catalytic grants that address the deep and diverse needs of the cashew sector. cashew. PRO-Cashew will co-invest with cashew producer organizations and agribusinesses engaged as implementing partners, prioritizing investments that are easily replicable by other actors in the value chain. This intervention will strengthen buyer-supplier relationships and ultimately improve the ability of farmers to meet quantity and quality requirements.



The PRO-Cashew project provides in-kind grants to cashew growers, farmer organizations, seedling distributors, SMEs, or other agricultural service providers to improve access to renovation services and rehabilitation (R&R) of cashew orchards, inputs, and/or promote the adoption of innovative and climate-resilient cashew production and post-harvest techniques. PRO-Cashew will provide the goods or services to its grantees under the grant portfolios.



Offerors are responsible for ensuring that CNFA receives their offers in accordance with the instructions, terms and conditions described in this RFQ. Failure to follow the instructions outlined in this RFQ may result in the disqualification of an offer from consideration.



CNFA will consider proposals in response to this RFQ from qualified local or regional vendors. CNFA will use a Global Purchasing Agreement (BPA) to establish price, terms and conditions for purchases as required for the items listed below. Prospective suppliers must agree to deliver all items identified in purchase orders issued under the APB. The purpose of this method is to have predetermined unit prices. Therefore, the cost proposed in this tender must be valid for the period of the BPA or for one year. CNFA will order such items through Purchase Orders under this BPA as required.



2. Registration deadline and protocol:   Bids must be submitted electronically or physically no later than 9th December 2022 at 5:00 p.m. to the email address [email protected]. Any submission of physical bids must be stamped and signed by the authorized representative of the bidder and delivered to the PRO-Cashew office located at CNFA/PRO-Cashew Project, 34 Boundary Road, East Legon, Accra, Ghana. Please refer to the bid solicitation number in any response to this RFQ. Bids received after the specified time and date will be considered late and will only be considered at CNFA's discretion. The cover page of this solicitation summarizes the important dates of the solicitation process. Initiators must strictly follow the prescribed deadlines to be rewarded.



3 Questions: Questions regarding the technical and/or administrative requirements of this RFQ may be submitted no later than 6th December 2022 at 5:00 p.m.by e-mail to [email protected]. Questions must be submitted in writing. Telephone calls will not be accepted. Questions and requests for clarification - and responses thereto - that CNFA believes may be of interest to other suppliers will be distributed to all recipients of the solicitation who have expressed interest in bidding.



Only written responses issued by CNFA will be considered official and carry weight in the bid solicitation process and subsequent evaluation. Any verbal information received from employees of CNFA or any other entity should not be considered an official response to any questions regarding this order request.



4. Technical requirements: The table below contains the technical requirements of the products/services. Offerors are requested to provide quotes containing the information below on official letterhead or official quote format.

CNFA will not accept partial offers - all items must be included in the proposal. All products offered in response to this RFP must be new and unused. Please note that unless otherwise stated, brand names or models mentioned are for illustrative purposes only. An equivalent substitute, as determined by the specifications, is acceptable.



5. Price offers: Submissions in response to this RFQ must be valued at a fixed, all-inclusive price, including delivery and all other costs. Offerors are required to submit a proposed payment terms and payment schedule, if applicable. Failure to provide payment terms may result in the Offeror's disqualification. Prices must be presented in Ghana cedi (GHS). Offers must remain valid for at least12 calendar months after the deadline for submission of tenders. Offerors are requested to provide offers on official letterhead in the format provided in Section 4 - Technical Requirements.



6. Evaluation: Award will be made to the supplier whose offer follows the RFQ instructions, meets the eligibility requirements and (lowest price approach, technically acceptable): meets or exceeds the minimum technical specifications required, and is deemed to be being the best value based on the lowest technically acceptable price. Only bidders deemed technically acceptable will be considered for the award of the contract. The Evaluation Committee will assess the acceptability of Offerors based on the following criteria:



 




  • Technical capacity: Meet or exceed the tender technical specifications listed in section 4: Technical requirements.

  • Past performance: Minimum of 2 years of experience supplying farm implements

  • Delivery time: Must deliver within 20 days of the blanket purchase order signature.

  • Guarantee: At least one year warranty and after-sales service for the equipment’s.

  • The record: Copy of the offeror's registration or business license

  • References: Three contacts for references from organizations/individuals for whom the Offeror has successfully performed similar work.



Best offer proposals are requested. It is intended that the award will be made solely on the basis of these original proposals. However, CNFA reserves the right to take any of the following actions:




  • CNFA may conduct negotiations with and/or request clarifications from any offeror prior to award;

  • While preference will be given to bidders who can meet all of the technical requirements of this RFQ, CNFA may issue a partial award or split the award among multiple vendors, if it is in the best interest of the PRO-Cashew project.

  • CNFA may revoke this RFQ at any time.



Please note that if there are deficiencies in meeting the requirements of this RFQ, an offer may be considered "non-responsive" and therefore disqualified from consideration. CNFA reserves the right to waive intangible deficiencies at its discretion.



7. Payment and award: Award will be made to the Offeror whose offer represents the best value for the project. Award will be made only to the entity that submits a proposal in response to this RFQ. CNFA will not award prizes to any other bidder, entity or third party other than the selected bidder(s). Any award and payment resulting from this RFQ shall be in the form of a Global Purchase Agreement (BPA). CNFA will use a Global Purchasing Agreement (BPA) to establish price, terms and conditions for purchases as required for the items listed below. Prospective suppliers must agree to deliver all items identified in purchase orders issued under the APB. The purpose of this method is to have predetermined unit prices. Therefore, the cost proposed in this tender must be valid for the period of the BPA or for one year. CNFA will order such items through Purchase Orders under this BPA as required. This award is subject to the terms and conditions of the PRO-Cashew project as defined in Annex 3.



8. Bid Format Instructions: Format Instructions: All proposals must be formatted in accordance with the requirements below:



(a) English language only



(b) Include individual/agency/organization name, date, RFQ number and page numbers as headers or footers throughout the document.



(c) The Technical Bid must be submitted in the format provided in Section 4.



A complete offer will include the following documents:




  1. A Bid Checklist (Appendix 1).

  2. A cover letter on company letterhead, signed by an authorized representative of the Offeror (Annex 2).

  3. A complete technical offer in response to the evaluation criteria of the section 6 and in the format provided in section 4.

  4. A copy of the offeror's operating license or, in the case of a natural person, a copy of their identity card.

  5. Three contacts for references from organizations/individuals for whom the Offeror has successfully performed similar work.

1. Ethical and Professional Conduct Requirements. CNFA is committed to integrated purchasing and only selects suppliers based on objective business criteria such as price and technical merit.

2. Terms and conditions: This solicitation is subject to CNFA's Terms and Conditions. Any resulting compensation will be governed by these terms and conditions; a copy of the full terms and conditions is available on request. Please note that the following terms and conditions will apply:



(a) CNFA's standard payment terms are net 30 days after receipt and acceptance of products or deliverables. Payment will only be issued to the entity submitting the offer in response to this RFP and identified in the resulting award; payment will not be issued to a third party.



(b) No product or service may be provided that is manufactured or assembled, shipped, transported or otherwise involves any of the following countries: Cuba, Iran, North Korea, Syria.



(c) All international transportation or shipping by air or sea under any award resulting from this bid solicitation must be on United States flag carriers/vessels.



d) United States law prohibits transactions with and the provision of resources and support to persons and organizations associated with terrorism. Supplier under the award arising from this order shall ensure compliance with such laws.



(e) Title to any goods provided under any award arising from this application shall pass to CNFA upon delivery and acceptance of the goods by CNFA. The risk of loss, injury or destruction of the Goods is with the Offeror until title passes to CNFA.



f) United States law prohibits engaging in activities related to human trafficking. Supplier under the award arising from this order shall ensure compliance with such laws.



g)The Offeror is prohibited from supplying certain telecommunications equipment or services as a substantial or essential component of any system, or as critical technology forming part of any system, produced by the following covered companies, and their subsidiaries and affiliates affiliates, in fulfillment of any resulting prize: Huawei Technologies Company; ZTE Corporation; Hytera Communications Corporation; Hangzhou Hikvision Digital Technology Company; Dahua Technology Company; and any other company as determined by the United States government. The Offeror certifies that it will not provide covered telecommunications equipment or services to CNFA in performance of the resulting contract.



3. Disclaimers: This is a one-time order request. Issuance of this bid solicitation does not in any way obligate CNFA, ​​The Pro-Cashew Project, or USDA to award or pay any costs incurred by prospective suppliers in preparing and submitting a bid. In addition :



(a) CNFA may cancel the solicitation and not the award;



(b) CNFA may reject any or all responses received;



(c) Issuance of tenders does not constitute an award commitment by CNFA;



(d) CNFA reserves the right to disqualify any bid based on the bid's failure to follow the RFQ instructions;



(e) CNFA will not compensate bids for meeting demand;



(f) CNFA reserves the right to issue a price based on the initial evaluation of bids without further discussion;



(g) CNFA may negotiate with proposed offers for their best and last offer;

(i) CNFA may reissue the solicitation or issue formal modifications, revising the original specifications and evaluation criteria before or after receipt of proposals;



(j) CNFA may modify the specification without issuing formal notice to all Offerors where the revisions are not relevant within the scope of the request;



(k) CNFA may choose to award only a portion of the activities in the RFQ, or issue multiple awards based on multiple RFQ activities;



(l) CNFA reserves the right to waive minor weaknesses in proposals that can be corrected prior to award determination to promote competition;



(m) By submitting a response to this bid solicitation, Bidders understand that USDA is not a party to this solicitation and the Offeror agrees that any protests set forth below be made - in writing with full explanations - to Project Pro-Cashew for review. USDA will not consider representations regarding contracts made by Implementing Partners. CNFA, ​​in its sole discretion, makes a final decision on any protest for this market.



4. Source/Nationality/Manufacture:



All goods and services offered in response to this RFQ or provided under any resulting award must be USDA Geographic Code compliant, pursuant to the United States Code of Federal Regulations (CFR), 22 CFR §228. The cooperating country for this RFQ is Benin.



Offerors may not offer or supply goods or services that are manufactured or assembled in, shipped from, transported through, or otherwise involve any of the following countries: Cuba, Iran, North Korea or Syria.



5. Taxes and VAT: As an organization that implements a project on behalf of the USDA, CNFA is exempt from VAT, customs duties, for goods and services purchased for USDA-funded activities. As such, bidders agree to exclude VAT or any other similar tax or charge from its cost proposal.



6. Eligibility: By submitting a bid in response to this bid solicitation, the bidder certifies that it and its principal officers are not disqualified, suspended, or otherwise considered ineligible for an award by the United States Government. CNFA will not award any contract to a company that is debarred, suspended, or deemed ineligible by the US government.



7. Delivery: The place of delivery of the items described in this invitation to tender is in accordance with section 4 of the RFQ. As part of its response to this RFP, each bidder is required to provide an estimate (in calendar days) of the delivery time (after receipt of order). The delivery estimate presented in a bid in response to this RFP shall be maintained in the performance of any resulting contract.



8. WarrantyWarranty and repair service in the cooperating country is required for all products covered by this RFP. Warranty coverage shall be valid for all products for a minimum of at least one year after delivery and acceptance of the products, unless otherwise specified in the technical specifications
